In United States v. Moore, 25 CR 7 (EDNY, May 13, 2026), Judge Vitaliano granted defendant’s motion to dismiss the portion of the indictment subjecting him to a potentially enhanced sentence under the Armed Career Criminal Act (ACCA) after determining that Hobbs Act robbery was not a violent felony within the meaning of ACCA.
