The firm won an important victory in Scott Roth, et al. v. Board of Managers of 299 West 12th Street Condominium (New York Supreme Court, Index No. 154312/2022). A decision dated October 12, 2023 by Justice Mary Rosado granted Schlam Stone’s clients the right to access privileged documents withheld by the defendants in the case. The Court ruled that defendants’ witness testimony at depositions had waived the privilege based on their defense that they had relied on the advice of counsel.
