White collar defense counsel, Jim Roberts, was recently quoted by Law360 Pulse discussing the recent FTX prosecution and corporate counsel who find themselves in the middle of the government’s investigation.
"The question becomes to what extent are they permitted to have a conversation with the government about what may or may not have been problematic conduct at the entity?" he said. Roberts said that the general counsel "was certainly a witness to or a participant in various company decisions" and that in the absence of a waiver, it was unclear what information counsel could convey that wouldn’t risk violating their duty to their client.
