On November 4, 2021, Schlam Stone & Dolan LLP attorneys Jeffrey M. Eilender, Joshua Wurtzel, and Jessica Caterina scored a major win in an eight-figure fraud suit, defeating defendants’ summary judgment motion and sending the case to trial.

Schlam Stone brought the suit in 2018 on behalf of a ticketing company and its owner against LiveXLive Media, Inc., a publicly traded live-streaming company, and its CEO, Robert Ellin, based on defendants’ allegedly fraudulent misrepresentations that induced Schlam Stone’s clients to enter into a multi-figure asset-purchase agreement.

Earlier this year, the defendants moved for summary judgment dismissing the fraud claims, arguing that plaintiffs’ reliance on the alleged misrepresentations was not reasonable and that plaintiffs couldn’t prove damages. But on November 4, the Honorable Jennifer Schecter of the New York County Commercial Division rejected defendants’ arguments and held that Schlam Stone’s clients’ claims must go to a jury.
