On June 28, 2022, Schlam Stone & Dolan partners Joshua Wurtzel and Jonathan Mazer successfully obtained an affirmance for their client at the First Department of the motion court’s denial of the defendants’ motion for summary judgment. In the suit, Schlam Stone’s client, a former one-third partner of a successful personal-injury law firm, alleges that his former two-thirds partner stole millions of dollars from the firm before breaking up in 2018. The suit, which is scheduled for trial in September 2022, was brought against Schlam Stone’s client’s former partner as well as the firm’s accountant, who allegedly helped conceal this theft. Both defendants moved for summary judgment, which was denied by the motion court and led to this appeal. In this decision, the First Department rejected almost all the defendants’ arguments, and held that a jury must decide Schlam Stone’s client’s claims. Another big win for the good guys!
